VoiceNotes - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the VoiceNotes application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1.1 Age Requirements

You must be at least 13 years old to use this App.

2. Description of Service

VoiceNotes is a mobile application that allows you to:

• Record voice notes and audio memos
• Transcribe recordings using AI (requires your own Google Gemini API key)
• Organize notes with categories and tags
• Search and manage your recordings
• Use AI features for summaries, titles, and interactive chat
• Export and share your voice notes

Platform: Android (Google Play Store) Requirements: Android 8.0 (API level 26) or higher

3. License and Usage

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

3.2 Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the App
• Use the App for commercial purposes without permission
• Attempt to gain unauthorized access to our systems
• Distribute or share the App in violation of applicable laws
• Modify, adapt, or create derivative works based on the App

4. User Responsibilities

4.1 Acceptable Use

You agree to use VoiceNotes only for lawful purposes. You will NOT:

• Record conversations without consent where legally required
• Record or store illegal content
• Violate any person's privacy, intellectual property, or other rights
• Use the App to harass, threaten, or harm others

4.2 Recording Laws

Important: Laws regarding recording conversations vary by jurisdiction. You are responsible for understanding and complying with local laws regarding consent for recording. We are not liable for your violation of recording laws.

4.3 API Key Responsibility

If you use AI features, you are responsible for:

• Obtaining your own Google Gemini API key
• Keeping your API key secure
• Complying with Google's Terms of Service
• All API usage charges

5. Privacy and Data Protection

5.1 Local Storage

All your recordings and data are stored locally on your device by default. We do not have access to this data.

5.2 No Data Collection

We do not collect, store, or transmit your personal data to our servers.

5.3 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App.

6. Intellectual Property

6.1 App Ownership

The App, including its design, code, functionality, and trademarks, is owned by Binod Swain and protected by intellectual property laws.

6.2 User Content

You retain all rights to your recordings and content. By using the App, you grant us no rights to your recordings.

7. Disclaimers

7.1 "As Is" Basis

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Transcription Accuracy

AI-generated transcriptions and summaries may contain errors or inaccuracies. They should not be relied upon for critical decisions and are provided for convenience only.

7.3 Service Availability

We do not guarantee that the App will be available at all times or that it will be error-free.

8. Limitation of Liability

8.1 Damages Limitation

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

8.2 Maximum Liability

Our total liability to you for all claims arising from or relating to the App shall not exceed the amount you paid for the App (if any).

8.3 User Content Liability

You acknowledge that we have no control over your recordings or content and are not responsible for illegal recordings you make.

9. Indemnification

You agree to indemnify and hold harmless Binod Swain from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of recording laws.

10. Termination

10.1 By You

You may stop using the App at any time by uninstalling it from your device.

10.2 By Us

We may terminate your access to the App if you violate these Terms, with or without notice.

11. Updates and Modifications

11.1 App Updates

We may release updates to improve the App's functionality, security, or performance. You are encouraged to install updates promptly.

11.2 Terms Updates

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App or through other reasonable means.

11.3 Acceptance of Changes

Your continued use of the App after such posting constitutes acceptance of the new Terms.

12. Dispute Resolution

Before filing any formal dispute, you agree to contact us to seek informal resolution of any concerns.

12.2 Arbitration

To the extent permitted by applicable law, any disputes arising from these Terms or the App shall be resolved through binding arbitration rather than in court.

These Terms are governed by the laws of India, without regard to conflict of law principles.
